These Terms of Service ("Terms") are a binding agreement between you and YourKitchen LLC ("YourKitchen," "we," "us," or "our"). By creating an account, accessing, or using the YourKitchen website, application, or services (together, the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms and our privacy practices described below. If you do not agree, do not use the Platform.
The Platform is intended for use within the United States and is currently offered as an early pilot. By using the Platform, you represent that you are able to agree to these Terms — or, if you are a minor, that a parent or legal guardian has reviewed and agreed to these Terms on your behalf and supervises your use. Anyone entering payment information represents that they are authorized to use the payment method provided.
YourKitchen is a meal-coordination platform. It allows a recipient's network of friends and family (the "village") to schedule and pay for meals to be ordered from independent restaurants and delivered by independent third-party couriers.
YourKitchen does not prepare, cook, handle, package, store, inspect, transport, or deliver any food. We do not own, operate, or control any restaurant, kitchen, or delivery service. We are a technology platform that connects users with independent third parties and facilitates scheduling and payment. The contract for any food order is between you, the restaurant that prepares it, and the courier service that delivers it.
Because users enter their own menu items and prices, prices shown on the Platform may not match a restaurant's current pricing. If a price is found to be inaccurate, an order may be cancelled and you may be asked to confirm the correct price before it is re-submitted.
All food is prepared by independent restaurants, and all deliveries are performed by independent courier services and their drivers. These are independent third parties, not employees, agents, or representatives of YourKitchen. We do not control and are not responsible for their acts, omissions, food preparation practices, hygiene, packaging, ingredients, timeliness, or conduct.
YourKitchen does not prepare, handle, inspect, or warrant any food ordered through the Platform. All food is prepared by independent third-party restaurants and delivered by independent third-party couriers.
YourKitchen makes no representation or warranty of any kind regarding the quality, safety, freshness, temperature, ingredients, nutritional content, preparation, or fitness of any food, and is not responsible for any allergic reaction, foodborne illness, contamination, injury, or harm arising from food ordered, prepared, delivered, or consumed.
You are solely responsible for reviewing menu items, ingredients, and allergen information directly with the restaurant, and for communicating any allergies, dietary restrictions, or medical needs. Notes entered on the Platform are conveyed to the restaurant on a best-effort basis and are not guaranteed to be followed.
Orders may be cancelled before they are dispatched to a courier. YourKitchen may cancel an order — including for an inaccurate menu price, an unavailable item, or an unavailable restaurant — and will make reasonable efforts to notify the coordinator and recipient. Once a meal has been prepared or dispatched, it may not be possible to cancel or refund it. Refunds, where applicable, are returned to the original payment method.
You acknowledge and agree that ordering food prepared by independent restaurants and delivered by independent couriers carries inherent risks, including risks related to food safety, allergens, and delivery. By using the Platform, you knowingly and voluntarily assume all such risks.
The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. YourKitchen does not warrant that the Platform will be uninterrupted, error-free, or secure.
You acknowledge that the Platform is currently offered as an early pilot and may contain errors, change without notice, or be unavailable from time to time.
To the fullest extent permitted by law, YourKitchen LLC and its owners, members, officers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, illness, allergic reaction, foodborne illness, property damage, or loss arising out of or related to the food, the restaurants, the couriers, or your use of the Platform — whether based in contract, tort, negligence, strict liability, or otherwise — even if advised of the possibility of such damages.
In no event will YourKitchen's total liability for any claim arising out of or related to the Platform exceed the greater of the service fees you paid to YourKitchen in the three months preceding the claim, or one hundred U.S. dollars ($100).
You agree to defend, indemnify, and hold harmless YourKitchen LLC and its owners, members, officers, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) any food ordered, delivered, or consumed through the Platform; or (d) any information, including prices and allergen details, that you entered.
You agree not to misuse the Platform, including by submitting false information, using it for any unlawful purpose, attempting to interfere with its operation, or using it to harass, abuse, or harm any person.
By providing a phone number, you consent to receive transactional text messages related to meal confirmations and deliveries. Message and data rates may apply. You can opt out at any time by replying STOP. You also agree to receive service-related emails.
We collect the information you provide (such as name, email, phone number, delivery address, and meal preferences) and information generated through your use of the Platform, in order to operate the service — including scheduling meals, processing payments through our payment processor, arranging delivery, and communicating with you. We share information with the third parties needed to fulfill an order (such as restaurants, delivery providers, and our payment and messaging providers). We do not sell your personal information. We retain information for as long as needed to provide the service and meet legal obligations. You may request access to or deletion of your information by contacting us at the address below.
The Platform, including its design, content, and trademarks, is owned by YourKitchen LLC and protected by law. You may not copy, modify, or distribute it without our permission.
We may update these Terms from time to time. The "Effective date" above will reflect the most recent version. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Platform will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction.
